Costa Rica Pensionado Visa: Requirements, Cost and Timeline

Who qualifies as a pensionado

Article 81 of Costa Rica's immigration law (Ley 8764) defines a pensionado as a foreigner who receives "monthly, permanent and stable pensions from abroad" of no less than $1,000 USD or its equivalent. The Reglamento (art. 100) adds the operative word: the pension must be vitalicia, for life.

That single word decides most files. A pension that ends at a fixed date, an annuity with a term, or savings withdrawn monthly do not qualify as a pension. What does qualify:

• U.S. Social Security retirement or disability benefits
• Canada Pension Plan (CPP) and Old Age Security (OAS)
• Government, military and public-employee pensions
• Private employer pensions paid for life
• Lifetime annuities, when the insurer certifies them as such

There is no minimum age. A 50-year-old with a lifetime disability pension of $1,000 is a pensionado; a 70-year-old drawing $1,000 a month from an IRA is not, and would look at the rentista category instead.

What the pension letter must say

The Reglamento asks for a "document issued by the competent authority" proving you "enjoy a pension for life" of at least $1,000 per month. In practice Migración looks for four things on the letter:

1. Your full name, matching your passport exactly
2. The monthly amount (gross is fine)
3. That the pension is permanent or for life, in words
4. Issuing institution, date and signature

Americans: the Social Security Administration's Benefit Verification Letter (available from your my Social Security account) states the monthly benefit and that benefits continue for life. It must then be apostilled by the U.S. Department of State, because it is a federal document, and officially translated. Private pension letters are apostilled by the Secretary of State of the state where the notary who witnessed the signature is commissioned.

Canadians: Service Canada's CPP/OAS statement of benefits, apostilled by Global Affairs Canada (federal document) or the province, and translated.

If the letter is silent on duration, ask the issuer for a supplementary letter that uses the words "for life" or "lifetime". A file that arrives without it is rejected outright, not sent back for correction.

Complete document list

Everything from outside Costa Rica must be apostilled (or consular-legalized) and translated into Spanish by an official translator. Since a 2024 Migración resolution, defective documents are rejected without appeal; only omitted documents get the ten-working-day grace period.

Fingerprint registration at the Ministerio de Seguridad Pública is no longer required at filing; it is done at the documentation stage, when you collect your card. CAJA enrollment is also a post-approval step, but it must be completed before Migración releases the DIMEX.

Spouse and children

One qualifying pension covers your whole immediate family. Ley 8764 art. 82 states that with the $1,000 amount the applicant "may request legal residence for themselves, their spouse and their children under twenty-five or adult children with disabilities." No additional income is required per dependent.

Each dependent files their own set of documents: birth certificate, criminal record (if over 18), passport copy, photos, consular registration and fees. The spouse adds the apostilled marriage certificate. Children between 18 and 25 must be unmarried and economically dependent on you.

Parents are not dependents of a pensionado. A parent who wants to join you applies separately, either with their own pension or under the special category for economically dependent relatives of a temporary resident.

What you can and cannot do as a pensionado

Live in Costa Rica indefinitely, enroll in the CAJA public health system (mandatory), open bank accounts, convert your driver's license, and import a vehicle (at full duty; the Law 9996 exemption window closed in July 2026).

Work for a Costa Rican employer: no. Temporary residents "may only carry out the remunerated or lucrative activities that the Dirección General authorizes" (Ley 8764 art. 80), and working without authorization is grounds for cancellation (art. 129). Owning a business, holding shares and receiving dividends, or earning remote income from abroad, are not prohibited by the immigration law.

Leave the country: as often as you like. Residency is cancelled only if you are absent for more than two consecutive years. An absence longer than one year at renewal time must be explained in writing and accompanied by a fresh criminal record check from the country where you stayed.

Timeline in 2026

The law gives Migración three months to decide once a file is complete (Ley 8764 art. 200). In 2026 the queue is far longer than that, though the card stage improved sharply after Banco de Costa Rica branches began printing DIMEX cards on the spot in March 2026. Renewal and the road to permanent residency

Temporary residency is granted for two years and renewed every two years (Reglamento art. 207). Renewal requires the card fees again, proof of uninterrupted CAJA enrollment since approval, and your passport. Renew within 30 days of expiry to avoid a $3-per-month penalty; a residency not renewed within three months of expiry lapses automatically.

After three consecutive years of temporary residency you may apply to change category to permanent residency, which removes the work restriction and stretches renewals to every three and then five years. Citizenship by naturalization is available after seven years of official residence (five for citizens of Spain and Ibero-American countries).

Pensionado or rentista?

If your income is a lifetime pension of $1,000 or more, pensionado is simpler and cheaper to document. If your income comes from investments, rental property, a business abroad, or savings, you cannot use it as a pension and should read pensionado vs rentista before deciding.
